also we are looking at the bay bridge toll plaza and the traffic here is moving along nicely. there are no major problems if you are driving through. it's taking about eight minutes to drive through. if you're in the east bay interstate 580 looks good coming up to the hayward area. it is a head on collision but it's not effecting 680 and 580. let go back to the desk. happening today the family of a city college student shot and killed by san francisco police are planning a day of protests. they are tying their demonstrations to the series of protests nation-wide over the police shooting of unarmed teenager michael brown in ferguson, missouri. alex savidge is live at san

francisco park. >> reporter: friends and relatives will be coming together for that sunrise ceremony not long from now to honor this 28-year-old man that was shot to death by san francisco police. his supporters are calling for police if to be held accountable. he was a city college of ever san francisco student witnesses before the shooting reported shing nieto acting spa ratically. his family believes officers over reacted and they are planning if to file a civil rights lawsuit against the police department. family's attorney says nieto was a peaceful person. >> and him being projected as if he was threatening a police officer was contrary to his

belief. >> the use of deadly force by police did prompt a demonstration last night at san francisco civic center plaza. it was billed as a day of rage. protestors expressed anger over the killing of alex nieto and the controversial police shooting in ferguson, missouri that left michael brown dead and there is more action planned locally later today. at noon supporters are planning to march from bernal heights park to the san francisco federal building and there will be a rally there. again this morning a half hour from now they will be planning a sunrise ceremony in his honor and we will be standing by for

that. tensions might be easing over the police shooting of michael brown. last night was the second straight night since the august 9th shooting that city streets emptied early. with conditions improving, missouri's governor ordered the national guard troops to pull out. and in other developments michael brown's parents are committed to see the officer that shot and killed their son go to prison. >> we are hurt. no telling what he is doing but he has his life. >> mourners left a trail of flowers at the site where he was shot. sheriffs deputies are investigating the death of two men in mill valley as a possible murder-suicide. officers found their bodies wednesday night in an adjacent backyard. both men died from gunshot wounds. investigators say a rifle was discovered next to one of the men. they are not currently looking

for any suspects in this case. >> i don't see any immediate regard. this appears at this point to be an isolated event. >> neighbors say one man who died was 61 years old and lived with his wife and son. they say the other was believed to be in his 40s and living next door at his parents home. time is 4:35. test results for a woman in sacramento that was thought to have possibly contacted the ebola virus in west africa came back negative. >> our advance public health and medical care systems have appropriate protocols in place to prevent the spread of this often deadly disease. i want to emphasize there are still no confirmed ebola cases in klz. >> the woman who's identity was not released was admitted to the hospital tuesday and kept in a specially equipped negative pressure room while blood samples were tested.

again to free army sergeant bowe bergdahl. the government accountability office says the pentagon broke the law when it failed to give congress a 30-day advanced notice of its plans to swap captured taliban fighters for bergdahl. the pentagon notified congress of the deal the same time the deal was made. the western u.s. has lost 63 trillion gallons of water dug the drought. scripts institute researchers say they came up with that measurement by measuring the earth's crust. the niners want to make sure the new grass will be ready for sunday's preseason game against the san diego chargers. you watched z them fly over as

the 49ers stake on the chargers at 1:00 p.m.. join us after the game for the point after. after winning their protest of a rain delay lost in chicago, the giants were still not able to beat the cubs after the game resumed. it took almost two hours to resume tuesday's game from where it left off in the bottom of the 5th. joe panic had an rbi single in the sixth but that will be the giants only run of the game. things went better for the giants in the third inning. the call stood. the giants went ahead in the fifth with a buster posey home run to left field. his 14th of the season. giants went on to win that game

in oakland. the fast moving flames caused major damage to two buildings near 23rd avenue and international boulevard wednesday night. investigators now say they found rem innocents of fire works at the scene and several people reported hearing a loud bang just seconds before they saw the flames. >> very loud. boom boom. >> i thought it was a regular fire work. >> no one was hurt but the fire forced more than 30 people find a place to live. the city of oakland will celebrate a new technology focused elementary school this weekend. aspire public schools will hold a ribbon cutting ceremony for its triumph academy in oakland tomorrow. the public charter school system serves mainly low income students from kindergarten through fifth grade. teachers must demonstrate

a new report says california is not doing all it can to fight and prevent cancer. the american cancer society report says california is making progress on preventing tobacco use and passing smock free laws, but it also says the state needs to do more to help people who already smoke to quit the habit. >> research shows that we can prevent nearly half of all cancer deaths if everyone were to quit tobacco. if everyone were to exercise regularly, eat a healthy diet. >> the report says an estimated 170,000 people in california will be diagnosissed with cancer this year and it says 58 how long others were die of kansas -- and 58,000 others will die of cancer.

a san francisco woman has pleaded not guilty to the tragic hit and run death of her two-year-old niece. loyresha gauge entered that plea yesterday. she cried during her arraignment on felony child

endangerment charges. prosecutors says she failed to protect miana gregory from being struck by a hit and run driver last friday night. her attorney says authorities should concentrate on finding the hit and run driver. >> i don't think it's right to have someone in custody or someone accused of a crime. when someone else is responsible for it. >> police believe the hit and run driver was behind the wheel of a light colored 1990 lexus or honda camry. three were arrested accused of stealing $6,000 worth of baby formula. they were all arrested. a fourth suspect is still at large. now placer county deputies say

a store owner saw them filling duffel bags with baby formula. it's often used to delute drugs or can be sold illegally online. california attorney general camera harris is planning to appeal a federal court ruling surrounding the states death penalty. it was ruled unconstitutional last month after the judge says it takes too long to carry out. since california reinstated the death penalty in 1978, only 13 executions have been carried out. there have been none since 2006 because of a stalement. currently there are 750 people on death row. time is 4:55. three dozen people out of a job and possibly out of their homes by the government forced closure. they are getting help this weekend. sausalito fish restaurant hosting a fundraiser. it's all in an effort to raise
